TERMS OF USE OF THE FITMATE APP
(EN version — 2025)
1. General information
- These Terms govern the use of the FitMate mobile application (the “App”) and the services available within it.

- By using the App, the User accepts these Terms.
2. Technical requirements
- Using the App requires a smartphone with iOS or Android and Internet access.
- FitMate is not liable for downtime resulting from technical limitations of the User’s device or from the operation of the Apple/Google platforms.
3. Registration and account

Registration requires providing:
- e-mail address,
- password,
- username,
- choice of one of the available avatars (m/f).
- Signing in with Apple ID is also possible.
- The User declares they are at least 16 years old and fully capable of using the App.
- FitMate does not verify the User’s age and relies on the User’s declaration.
- The User is responsible for keeping login credentials confidential.
4. Scope of functionality

The App enables in particular:
- Logging workouts, meals, calories, weight, and body measurements.
- Viewing history, statistics, and charts.
- Communicating with a selected trainer via chat (including sending photos).

Using AI-based features:
- MateGPT – a chatbot providing answers related to fitness, diet, and training;
- a workout plan generator;
- an automatic daily calorie goal generator (input data is not stored or sent to the server).
- Managing Premium subscriptions and Trainer subscriptions.
5. Rules for working with trainers
- A separate subscription can be purchased in the App to access Trainer services.
- Trainers act as external partners/contractors of FitMate.
- The User grants the trainer access to their training and nutrition data — access can be revoked at any time.

The trainer may:
- view data logged by the User,
- log workouts and meals,
- set training goals,
- send plans and guidance.
- After access is revoked, the trainer no longer sees chat history or the User’s data.
- Chat history remains in the system (internal archive for safety and compliance) but is not available to any trainer after disconnection.
- The following is prohibited:
- sharing contact details outside the App,
- arranging cooperation bypassing the FitMate system,
- offering services outside the App.
- Violations may result in the trainer’s account being blocked.
6. Subscriptions and payments
- FitMate offers:
- a Premium subscription (monthly or annual),
- a Trainer subscription (monthly).
- A 3-month Premium trial is available for new Users – not applicable to trainers.
- Payments are processed by Apple/Google → FitMate does not store payment data.
- FitMate uses RevenueCat as an intermediary for subscription handling.

Trainers receive compensation reduced by:
- FitMate’s commission,
- platform commissions,
- tax costs on FitMate’s side.
- FitMate’s commission is variable and set individually.
- The trainer subscription cannot be canceled with a refund, because some services (including training plans) constitute a non-refundable digital good.
- The User may opt out of renewal for the next period but will not receive a refund for the period already paid.
- Purchase transfers are possible only according to Apple mechanisms (restore purchases).
7. Prohibited content

It is forbidden to send:
- pornographic content or content inappropriate for minors,
- hateful, aggressive, or offensive content,
- contact details intended to bypass the FitMate system,
- spam and advertising.
8. Liability and limitations
- The FitMate App and Trainers do not provide medical services.
- Information generated by AI (MateGPT), the workout plan generator, and calorie generators is for informational purposes only.
- The User uses AI features at their own risk and responsibility.
- In case of injury, pain, or health doubts, the User should consult a doctor or physiotherapist.
- FitMate is not liable for:
- following AI or Trainer suggestions,
- effects of incorrect use of the App,
- damage resulting from false data provided by the User.
9. Deleting an account
- An account can be deleted within the App.
- Identifying data (e-mail, login, password) is deleted immediately.
- Training, nutrition, and statistical data are retained in anonymized form, without any possibility of linking to the User.
- Chat history is archived and is not available to trainers or other Users.
- A new account created with the same e-mail is treated as entirely new, with no ability to recover previous data.
10. Photo rules
- Photos sent in chat may be deleted after 30 days, but FitMate does not guarantee automatic and immediate removal.
- Food photos (calorie analysis) are not stored on FitMate servers — they are sent directly to OpenAI.
- OpenAI may store or use photos to train models, in line with its own policy.
11. Final provisions
- FitMate may make changes to the Terms. The User will be informed about material changes with appropriate notice.
- In matters not regulated herein, Polish law and applicable EU regulations apply.
- Using the App constitutes acceptance of the Terms.
